§ 2-141. Violations declared infractions; penalty; costs of contesting.

  • (a)

    A violation of a city code or ordinance is a civil infraction. Each violation of a city code or ordinance is a separate civil infraction. Each day such violation shall continue shall be deemed to constitute a separate civil infraction.

    (b)

    The maximum civil penalty pursuant to this section shall not exceed $500.00, plus all applicable court costs, legislative assessments, administrative fees and service of process charges, per violation.

    (c)

    The citations issued pursuant to this division may be contested in county court.

    (d)

    An alleged violator who elects to contest the violation in county court shall be responsible for payment of all applicable court costs and appropriate assessments and reasonable attorneys fees in addition to the civil penalty if the alleged violator is found by the court to be in violation.

    (e)

    The county court has the authority to issue all orders necessary to abate any City Code violation and secure compliance with the City Code of Ordinances, including, but not limited to, authorizing the city to abate the violation and lien the violator's property for the cost of abatement.
